Toss and Catch Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of TossandCatch.com and the Toss and Catch platform (“Toss and Catch,” the “Platform,” or the “Service”).
Toss and Catch is operated by The Kirk Group.
By accessing or using Toss and Catch, you agree to these Terms. If you do not agree, you should not use the Service.
1. About Toss and Catch
Toss and Catch is an online platform designed to connect homeowners and other customers seeking services with independent local service providers.
Users may submit service requests, and eligible service providers may receive information about available service opportunities.
2. Toss and Catch Is a Connection Platform
Unless expressly stated otherwise for a particular service, Toss and Catch provides a platform that facilitates connections between customers and independent service providers.
Service providers are independent businesses or individuals and are not employees, agents, partners, or representatives of Toss and Catch or The Kirk Group.
Toss and Catch does not control the manner in which independent service providers perform their services.
Users are responsible for evaluating whether a particular provider is appropriate for their needs.
3. User Accounts
Certain features may require creation of an account.
You agree to provide accurate and current information and to maintain the confidentiality of your account credentials. You are responsible for activity conducted through your account.
You must promptly notify Toss and Catch if you believe your account has been accessed or used without authorization.
4. Service Requests
Customers may use Toss and Catch to describe services they are seeking. Information may include the type of service, general location, timing, description, photographs, and other details necessary for providers to evaluate the opportunity.
Submitting a service request does not guarantee that a provider will respond, accept the request, or perform the requested service.
5. Independent Service Providers
Service providers using Toss and Catch are responsible for determining whether they are qualified and legally permitted to perform the services they offer.
Where applicable, providers are responsible for maintaining required licenses, permits, insurance, registrations, and other qualifications.
Toss and Catch does not guarantee the quality, safety, legality, availability, pricing, licensing, insurance status, or performance of any independent service provider.
6. Agreements Between Users
Any agreement concerning the scope, price, timing, payment, warranty, or performance of services is between the customer and the service provider unless Toss and Catch expressly states otherwise.
Users should independently confirm important details before agreeing to or beginning work.
7. SMS/Text Messaging Terms
Toss and Catch offers optional transactional SMS notifications related to use of the Platform.
Users who expressly opt in may receive messages concerning service requests, available jobs, job-status updates, account activity, and other transactional communications associated with Toss and Catch.

Message frequency: Varies according to account and service activity.
Charges: Message and data rates may apply.
Opt-out: Reply STOP to discontinue SMS messages.
Help: Reply HELP for assistance or contact support@tossandcatch.com.
Consent to receive SMS messages is not a condition of purchasing goods or services or using the Toss and Catch platform.
After opting out, you may receive a confirmation message acknowledging your request. You will no longer receive messages covered by that consent unless you subsequently opt in again.
These disclosures cover the specific items Telnyx currently asks to see in SMS program Terms, including the brand/program name, product description, variable message frequency, customer-care contact, STOP instructions, and the message/data-rate disclosure.
8. Acceptable Use
You may not use Toss and Catch to engage in unlawful, fraudulent, deceptive, abusive, threatening, or harmful conduct; impersonate another person or business; submit false or misleading service requests; distribute spam or unauthorized advertising; interfere with the operation or security of the Platform; attempt unauthorized access to accounts or systems; scrape or systematically extract Platform data without authorization; or use Toss and Catch for purposes that violate applicable laws or regulations.
We may restrict or terminate access when we reasonably believe these Terms have been violated.
9. Fees and Payments
Certain Toss and Catch features or services may require payment.
Any applicable fees, subscription charges, lead fees, transaction fees, or other charges will be disclosed before the applicable purchase or transaction.
Additional payment terms may be presented when purchasing a paid service.
10. User Content
Users may provide descriptions, photographs, messages, reviews, business information, and other content through Toss and Catch.
You retain ownership of content you provide but grant Toss and Catch permission to host, process, display, transmit, and otherwise use that content as reasonably necessary to operate and improve the Platform and provide requested services.
You are responsible for ensuring that you have the right to provide content you submit.
11. Intellectual Property
The Toss and Catch name, website, software, graphics, logos, designs, text, and other Platform materials are owned by or licensed to The Kirk Group and are protected by applicable intellectual-property laws.
These materials may not be copied, reproduced, distributed, modified, or commercially exploited without authorization.
12. Third-Party Services
Toss and Catch may integrate with or link to services operated by third parties. Those services may be subject to separate terms and privacy policies.
Toss and Catch is not responsible for third-party websites or services that it does not control.
13. Disclaimer of Warranties
Toss and Catch is provided on an “as is” and “as available” basis to the fullest extent permitted by law.
We do not guarantee uninterrupted availability of the Platform or guarantee that any service provider or customer will successfully complete a transaction or service engagement.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Toss and Catch and The Kirk Group will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Platform or interactions between users.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Toss and Catch and The Kirk Group from claims, liabilities, losses, damages, and reasonable expenses arising from your violation of these Terms, misuse of the Platform, or violation of another person’s rights.
16. Suspension and Termination
We may suspend or terminate access to Toss and Catch if a user violates these Terms, engages in fraudulent or abusive activity, creates security risks, or uses the Platform unlawfully.
Users may stop using Toss and Catch at any time.
17. Changes to These Terms
We may modify these Terms periodically. Updated Terms will be posted on TossandCatch.com with a revised effective date.
Continued use of the Service following an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.
18. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
